This document is a template for product use and is not legal advice. Have qualified counsel review and adapt it for your entity, markets, and model providers before relying on it in production.
These Terms govern your access to Dreamer, including credits, subscriptions, and AI generation tools powered by multiple model providers.
By creating an account, accessing, or using Dreamer (“Dreamer,” “we,” “us,” or “our”) websites, mobile applications, APIs, or related services (collectively, the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy and Acceptable Use Policy.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If local law requires a higher age for AI or paid digital services, that higher age applies.
You are responsible for accurate registration information, safeguarding credentials, and all activity under your account. Notify us promptly of unauthorized use at support@dreamer.app.
We may suspend or terminate accounts that violate these Terms, pose security or legal risk, or remain inactive for an extended period.
Dreamer provides tools to generate, edit, organize, and optionally publish media (including images, video, audio, and text) using artificial intelligence.
Generation features may be powered by multiple third-party model providers and infrastructure partners (“Model Providers”). Model availability, quality, latency, pricing in credits, and capabilities may change without notice as we add, replace, or configure providers.
Outputs can be inaccurate, biased, offensive, non-unique, or similar to content produced for others. You must review outputs before relying on or publishing them. Dreamer does not guarantee that any output is fit for a particular purpose, free of third-party rights, or compliant with laws in your jurisdiction.
We may impose rate limits, queues, content filters, geographic restrictions, or feature gating by plan.
“Input” means prompts, scripts, uploads, settings, and other materials you submit. “Output” means media or text the Service returns in response to Input.
Subject to these Terms and applicable law, as between you and Dreamer, you retain rights in your Input. You grant Dreamer a worldwide, non-exclusive license to host, process, transmit, and display Input solely to operate, secure, improve, and provide the Service (including routing Input to Model Providers as needed to fulfill your requests).
To the extent permitted by law and by our agreements with Model Providers, we assign to you any rights we may have in Output generated for your account from your Input, subject to: (a) your compliance with these Terms and the Acceptable Use Policy; (b) any residual rights or constraints of Model Providers; and (c) the fact that Output may not be unique.
You are solely responsible for ensuring that your use of Input and Output (including commercial use, publishing to Explore, marketing, or training other systems) does not infringe others’ rights or violate law. Dreamer does not provide legal clearance for Output.
If you publish content to Explore or other public areas of the Service, you grant Dreamer a license to host, display, distribute, and promote that content within the Service and in marketing that showcases the platform, unless a feature expressly states otherwise.
Paid features may consume credits or require a subscription. Credit costs per tool are estimates and may change. Failed, filtered, or cancelled jobs may still consume credits according to posted rules.
Purchases and subscriptions are processed by payment providers (for example, Flutterwave or others we designate). Their terms apply to payment processing. Taxes may be added where required.
Unless required by law or expressly stated at purchase, fees are non-refundable. Credits typically have no cash value and are non-transferable except as required by law.
We may correct pricing errors, revoke fraudulently obtained credits, and change plans prospectively with reasonable notice where practicable.
The Service, branding, software, documentation, and non-user content are owned by Dreamer or its licensors. These Terms do not grant you rights to copy, modify, reverse engineer (except where mandatory law allows), or resell the Service.
Feedback you provide may be used by us without obligation to you.
You must comply with our Acceptable Use Policy, which is incorporated into these Terms. Prohibited uses include illegal activity, exploitation of minors, severe harassment, malware, unauthorized scraping, attempts to extract model weights, or generating content that violates applicable law.
We may remove content, throttle access, or report activity to authorities when we reasonably believe it is necessary to protect users, the Service, or to comply with law.
Our Privacy Policy describes how we collect and process personal data, including when Input is sent to Model Providers to fulfill generation requests.
THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant uninterrupted or error-free operation, or that Output will meet your requirements or be free from harmful content.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMER AND ITS SUPPLIERS (INCLUDING MODEL PROVIDERS) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO DREAMER FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US $50) OR LOCAL EQUIVALENT.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
You will defend and indemnify Dreamer and its affiliates, officers, and partners against claims, damages, and expenses (including reasonable legal fees) arising from your Input, Output, use of the Service, or violation of these Terms or third-party rights—except to the extent caused by our willful misconduct.
You may stop using the Service at any time. We may suspend or terminate access for breach, legal risk, non-payment, or Service discontinuation.
Upon termination, your right to use the Service ends. Provisions that by nature should survive (including ownership, disclaimers, liability limits, and indemnity) will survive.
We may modify the Service and these Terms. Material changes will be posted with an updated date, and where required we will provide additional notice. Continued use after the effective date constitutes acceptance, except where mandatory law requires explicit consent.
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Courts located in the Federal Republic of Nigeria will have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court for IP or unauthorized access claims.
If a dispute arises, contact legal@dreamer.app before formal proceedings so we can try to resolve it informally.
These Terms are the entire agreement regarding the Service and supersede prior agreements on the same subject. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
